iBeach 31 Waiver and Release of Claims

For and in consideration of my participation in iBeach 31. LEAGUE (hereinafter the “LEAGUE”), I, for myself, my heirs, executors, successors, administrators and assigns, understand and agree as follows:

Assumption of Risk:  I acknowledge and understand that participation in the activities of the LEAGUE may involve the risk of bodily injury, property damage or death due to terrain, facilities, temperature, weather, MY physical OR mental condition, equipment, vehicular traffic, lack of hydration, infectious diseases such as Covid-19, or the negligent or non-negligent acts or omissions of other participants, or of the agents, volunteers, sponsors, contractors, subcontractors, representatives, employees of the LEAGUE.  I am voluntarily participating in the LEAGUE with knowledge of the risks involved and agree to accept all risks of injury or damage arising from, or as a result of, my involvement in the activities of the LEAGUE.

Release and Waiver:  I hereby agree to release and discharge the LEAGUE, its owners, shareholders, members, agents, officers, directors, managers, contractors, volunteers and employees, from any and all claims, demands, damages, liabilities, obligations, penalties, fines, causes of action, suits, legal fees and costs, of whatever nature, character or description, for bodily injury, property damage or death, including without limitation personal injury or death as a result of any infectious disease such as Covid-19, that arise out of or in connection with my participation in the activities of the LEAGUE (“Claims”).  To the full extent permitted by law, this release includes any and all Claims that in fact or as alleged arise out of, or are the result of, the negligent or wrongful acts or omissions of the LEAGUE or its owners, shareholders, members, agents, officers, directors, managers, contractors, volunteers and employees. 

Indemnity and Hold Harmless:  I hereby agree to indemnify and hold harmless the LEAGUE, its owners, shareholders, members, agents, officers, directors, managers, contractors, volunteers and employees, from any and all claims, demands, damages, liabilities, obligations, penalties, fines, causes of action, suits, legal fees and costs, of whatever nature, character or description, by any person, including without limitation other participants in the activities of the LEAGUE, for bodily injury, property damage or death, including without limitation personal injury or death as a result of any infectious disease such as Covid-19, that arise out of or in connection with my negligent or non-negligent acts or omissions while participating in the activities of the LEAGUE (“Claims”).  To the full extent permitted by law, this indemnity and hold harmless extends to any and all Claims that in fact or as alleged arise out of, or are the result of, the negligent or wrongful acts or omissions of the LEAGUE or its owners, shareholders, members, agents, officers, directors, managers, contractors, volunteers and employees. 

Additional Provisions:  I hereby understand and agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the State of Indiana and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.  I hereby understand and agree that this agreement is to be interpreted, enforced and governed by and under the laws of the State of Indiana and I hereby understand and agree the exclusive jurisdiction and venue for any lawsuit relating to any dispute which may arise out of or in connection with this agreement is Marion County, Indiana. 

Persons must be at least 19 years of age to participate in athletic events and by signing this Waiver and Release certify they are at least 19 years old.

BY SIGNING BELOW I UNDERSTAND THAT I UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT.
